Orders and purchases Online / Phone 

We conduct financial transactions via secured payment gateways Sage Pay, PayPal, Splitit to allow for the encryption of all transactions submitted on our Sites in order to protect your Credit / Debit card and other information. If you submit an order for a product on the Fruity Gift Sites or purchase product over the Phone, you will be required to provide a verifiable and accurate identity and contact information, delivery and billing address, and payment information. This personally identifiable information will be used for billing purposes and to fill product orders, to send you emails and text/Sms messages about promotions if you have opted in, and maybe retained for record-keeping and legal purposes along with the content of your order. No payment information, such as Credit/Debit card details is stored at Fruity Gift site! 

Call Recordings

Recording of calls is necessary to protect the interests of you, our customers and our staff. This privacy notice explains how we use recordings of phone calls.  When a call is recorded we collect a digital recording of the telephone conversation, the telephone number of both parties (internal and external). Personal data revealed during a telephone call will be digitally recorded for example name and contact details to deliver appropriate services. Phone call recording will be turned off, when a customer's credit or debit card details are given, in line with Payment Card Industry Data Security Standards (PCS DSS) and data protection legislation including General Data Protection Regulations ('GDPR').

Call recordings will be used

  • To assist in the monitoring of staff performance and adhere to quality standards
  • To investigate and resolve complaints.
  • For the detection, investigation, and prevention of crime (including fraud).
  • To take action to protect staff from abusive callers.
  • All call recordings are held securely by the IT Service. Only a Head of Service may request a copy of a call through a prescribed form for a specific reason.

Sharing data under Data Protection legislation

We may be required or permitted, under Data Protection legislation, to disclose a call recording including your personal data without your explicit consent, for example, if we have a legal obligation to do so, such as for:

  • Law enforcement
  • Fraud investigations
  • Criminal prosecutions
  • Court proceedings 

Recordings are kept securely and confidentially!

Electronic Mail and Social Media

Fruity Gift may retain the content of any e-mail or social media posting that Fruity Gift receives, the email or social media account address from which it is sent, and our response. Content and other information in or related to emails sent by you to Fruity Gift or postings, photos or video on any of Fruity Gift social media platforms, such as Facebook, Twitter, Google+, Instagram, YouTube may be used for other marketing purposes (as "Testimonials"), or in accordance with the Terms. Website Security / Payments

We use strong payment authentication procedures and have appropriate security measures in place to attempt to protect against the loss or misuse of your personally identifiable information. We use secure technology such as sockets Site Lock, Standart SSL, encryption algorithms to secure sensitive information submitted to us in orders. However, no security system is impenetrable!
It is the duty of the account holder to keep safe credit/debit card details or any kind of sensitive payment data. We can not liable for transactions made on our website by the third party with credit/debit cards without cardholder's permission. You need to contact us or contact your bank if feel that your card was used for purchases on our websites without cardholder authorisation.  
It is a duty of the account holder to notify it's Bank when an account has been compromised. It should always be to get in touch with the credit/debit card provider and to notify them as soon as possible or at a reasonable time ( a Month) if fraudulent transactions occur on their bank statement.
We do not take responsibility, We are not liable for the cost when credit/debit cardholder details are used in fraudulent transactions through our website. The account holder is responsible for and must pay the cost of the fraudulent transaction - when:
They failed to inform the bank that a card was lost or stolen or that someone knows their PIN or other card details.
If their Credit/Debit card details were exposed.
They've acted without reasonable care: by, for example, writing down the card PIN number or other card details.  
If an additional cardholder is liable for any of the reasons above and in accordance with our terms and conditions, those who "contributed to, were involved in, or benefited from the loss, theft or [the card's] misuse" won't get a refund!

Products Policy

We endeavour to display as accurately as possible the products available for sale on our Website. However, the colours and images that you will see on our Website will depend on a number of factors such as your monitor and its settings. Therefore, we cannot guarantee that the colour or other features of products shipped to in accordance with your order(s) will appear exactly the same as the image you see displayed on the Website.
